These terms and conditions ("Terms ") apply to your use of the gift voucher web site ("Website"), and when you purchase a gift voucher ("Gift Voucher") from any of the hotels listed here (“Templeton Garden”, “we”, “us”, “our”).

We are the Templeton Garden, however, as you have selected to purchase a Gift Voucher, we would draw your attention to the fact that this section of the Website is operated and managed by SK Chase Limited ("SK Chase"), who in its capacity as the service provider will collect payments from you on behalf of the Templeton Garden. SK Chase is a company incorporated in Scotland (No SC253912) with its registered office at 31 Palmerston Place, Edinburgh, EH12 5AP. The Templeton Garden website has separate terms and conditions which apply to the use of that website.

Before placing an order on the Website, you will be asked to agree and to be legally bound by these Terms. Please read them carefully before you submit your order. If you do not accept these Terms, you will not be able to purchase the Gift Vouchers from the Website.

We, the Templeton Garden, reserve the right to vary these Terms from time to time. It is your responsibility to regularly review these Terms while using the Website or before each purchase to keep up to date with any changes to them.

1.  Purchase

1.1  The Website offers Gift Vouchers for sale.

1.2  No contract for the sale of any Gift Voucher will subsist between you and the Templeton Garden unless and until the Templeton Garden accepts your order by way of an email (issued by SK Chase on behalf of the Templeton Garden) detailing the content of the Gift Voucher purchased, confirming that payment has been received in full, and confirming your details (the "Confirmation"). (This is a system generated email and therefore may go to the email recipient's junk or spam email folder. Please also ensure that the email address that you enter is correct. If an email delivery fails, we will attempt to contact you to advise that the email has been returned to us 'undelivered' and will try to get another email address.)  That acceptance will be deemed to be complete and for all purposes to have been effectively communicated to you at the time SK Chase (on behalf of the Templeton Garden) sends the Confirmation to you. The Confirmation amounts to an acceptance by the Templeton Garden of your offer to buy Gift Voucher(s) from the Templeton Garden or a third party supplier that is engaged by the Templeton Garden and these Terms.

1.3  You must check that the details of the Confirmation are correct as soon as possible and you should print out and keep a copy of it.

1.4  If purchasing a Gift Voucher through the Website, payment shall be taken on our behalf by SK Chase, as an agent for us, by credit or debit card. You can make payments with the following cards: Mastercard, Visa, Delta, American Express, Switch or Solo. Please note that any payments deducted by SK Chase from your account or refunded back to you will appear on your statement as being from SK Chase.

1.5  You undertake that all details you provide to the Templeton Garden and SK Chase for the purpose of ordering any Gift Vouchers are correct, that the credit or debit card you are using is your own, and that there are sufficient funds to cover the cost of the Gift Voucher ordered.

1.6  In order to protect your details during ordering, the Website uses a software package known as Secured Sockets Layer (SSL), which is indicated by a padlock which will appear in the bottom left hand corner of the web browser (grey border area of the screen).

1.7 The Templeton Garden reserves the right to cancel, suspend, or refuse redemption of any Gift Voucher in case of suspected of fraud, misuse, or obtained through unauthorized channels. The Gift Voucher(s) shall not be applicable for redemption in conjunction with any other offer/promotion or benefit(s), if available to you.1.8 If the value of your purchase exceeds the value of the Gift Voucher, you must pay the remaining balance at the time of redemption using an accepted credit or debit card or other approved payment method.

2.  Issuing Gift Vouchers

2.1  Each Gift Voucher sold is subject to terms and conditions of use which can be viewed on the Website alongside each individual Gift Voucher which shall apply in addition to the terms Terms. All prices on the Website are inclusive of VAT (where applicable).

2.2 If the physical delivery option is available and you opt for the same, Gift Vouchers purchased through the Website will be delivered by SK Chase to the address provided during the purchase process. Delivery timelines may vary depending on the destination. Within the United Kingdom, Gift Vouchers are usually delivered within 10-15 business days.  For destinations within Europe, delivery typically takes up to 15-20 business days. Delivery period may increase during peak season. For all other international locations, delivery timelines may vary on a case-by-case basis. Neither the Templeton Garden or SK Chase shall not be held liable for delays caused by factors beyond our control, including but not limited to postal service disruptions, incorrect address details, or unforeseen logistical issues.

2.3 Please note that postage and packaging charges are not included in the Gift Voucher prices. Any postage and packaging charges which apply are advised to you during the check-out and ordering process before you confirm your order.

2.4 Gift Vouchers may be redeemed in one or more transactions, subject to system capability. Any remaining balance will remain on the Gift Voucher until the expiry date. No cash alternative or change will be given for unused balances. Lost, stolen, or destroyed Gift Vouchers will not be replaced, refunded, or exchanged except at the Templeton Garden’s sole discretion. Proof of purchase may be required. Risk of loss and title for electronic Gift Vouchers pass to you upon transmission of the email to the address provided. For physical Gift Vouchers, risk passes upon delivery to the postal or courier service.

3.  Cancellations and Refunds

3.1 Please remember that, in addition to the these  Terms, the terms and conditions which will apply to each Gift Voucher will be individual to each Gift Voucher and can be viewed on the Website alongside each individual Gift Voucher. In case of any inconsistency between these Terms and the terms mentioned on the Gift Voucher, the terms mentioned on the Gift Voucher with prevail. The following provisions in this section 3 will apply in respect of all Gift Vouchers, unless:

(a)  the Gift Voucher is for a specified date or period of performance; or

(b)  the Gift Voucher is for:

-  any products made to your specification or clearly personalised;

-  newspapers, periodicals, or magazines with the exception of subscription contracts for the supply of such publications;

-  any goods which are liable to deteriorate or expire rapidly (such as food or fresh flowers);

-  any alcoholic beverages where (i) their price has been agreed at the time of the conclusion of the contract; (ii) the delivery of them can only take place after 30 days, and their value is dependent on fluctuations in the market which cannot be controlled by the trader; or

-  software, DVDs or CDs which have a security seal which you have opened or unsealed,

in which case the Gift Voucher is non-refundable and non-transferable unless otherwise agreed by us.

3.2  All specific arrangements regarding booking dates and times must be made directly with the Templeton Garden using phone or email [PJB2] , and you should reconfirm any arrangements made with us a few days before the event. We will use all reasonable endeavours to meet your request but cannot guarantee any specific date or time. The Templeton Garden is not liable for services provided by third-party suppliers engaged for fulfilling the Gift Voucher experience.

3.3  Gift Vouchers cannot be redeemed after the expiry date unless extended at the Templeton Garden’s sole discretion and may be subject to additional terms and conditions.

3.4  Subject to clause 3.1 above, you have the right to cancel your order with us starting from the date that SK Chase sends you the Confirmation (which is when the contract is formed with the Templeton Garden), until either:

(a)  14 business days from the day after the day of receipt of Confirmation Email for your Gift Voucher, if your order is for one Gift Voucher; or

(b)  14 business days from the day after the day of receipt of the last of the Gift Vouchers ordered, if your order is for multiple Gift Vouchers which are delivered on separate days,

(the respective "Cancellation Period")

3.5   If you wish to cancel your order either before or after you receive the Gift Voucher, you must notify SK Chase within the Cancellation Period that you have decided to cancel the order. The easiest way to do this is to contact SK Chase in accordance with clause 4.1. If you decide to cancel by email, your cancellation will be effective from the date you sent SK Chase the email. If you have already received the Gift Voucher which you have cancelled, you should destroy it.

3.6  Should you cancel the order within the Cancellation Period, SK Chase (on behalf of the Templeton Garden) will then refund you the price you have paid for the Gift Voucher(s) to your original payment method within 14 business days after the day on which SK Chase receives the notice of cancellation from you (irrespective or not of whether you have received the Gift Voucher).

3.7   This refund will not include the delivery charge, if any, paid by you if the voucher has already been couriered/posted to you. However, if the Gift Voucher is faulty or mis-described, SK Chase (on behalf of the Templeton Garden) will refund the delivery charges (if the postal delivery option was chosen). In respect of a refund of the delivery charges paid by you, the maximum refund will be the costs of delivery by the least expensive delivery method offered (the cost of UK First Class post). If SK Chase finds, after it has received your notice of cancellation, that the Gift Voucher has been used, you shall not be entitled to a refund.

5.  Liability 

·       Any indirect, incidental, or consequential losses, including loss of profit, revenue, goodwill, or anticipated savings.

·       Any failure or delay caused by circumstances beyond our reasonable control.

·       Any errors in the information provided by you at the time of booking or Gift Voucher issuance.

Notwithstanding anything to the contrary, the Templeton Garden’s maximum aggregate liability shall not exceed the value of the Gift Voucher purchased with respect to which the liability arose.
